1. Acceptance of Terms Welcome to 10,000 Bird Tours Inc. (“Company,” “we,” “our,” or “us”). By accessing or using our website, [10000birdtours.com] (the “Site”), and the services we provide (collectively, the “Services”), you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Services.

2. Eligibility By using the Services, you represent and warrant that you are of the age of majority in your jurisdiction of residence and have the legal capacity to enter into these Terms. If you are accessing the Services on behalf of a business or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

3. Changes to Terms We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

4. Use of Services You agree to use the Services only for lawful purposes and in compliance with all applicable laws, regulations, and these Terms. You may not:

  • Use the Services in any manner that could harm, disable, overburden, or impair the Site.
  • Interfere with the security, integrity, or functionality of the Services.
  • Use automated systems (e.g., bots, scrapers) to access the Site without our prior written consent.

5. User Accounts You may be required to create an account to access certain features of the Services. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

6. Intellectual Property All content on the Site, including text, graphics, logos, and software, is the property of the Company or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our express written consent.

7. User Content If you submit or upload content to the Site (“User Content”), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, and display your User Content in connection with the Services. You represent and warrant that you own or have the necessary rights to your User Content.

8. Privacy Your use of the Services is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the Services, you consent to the practices described in the Privacy Policy.

9. Third-Party Links The Site may contain links to third-party websites or services. We do not endorse or control these third parties and are not responsible for their content or practices. Use these links at your own risk.

10. Limitation of Liability To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages.

11. Disclaimer of Warranties The Services are provided “as is” and “as available,” without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or secure.

12. Indemnification You agree to indemnify and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising out of your use of the Services or violation of these Terms.

13. Governing Law These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be resolved in the courts of British Columbia.

14. Termination We reserve the right to terminate or suspend your access to the Services at our sole discretion, without notice, for conduct that violates these Terms or is otherwise harmful to the Services or users.

15. Entire Agreement These Terms constitute the entire agreement between you and the Company regarding your use of the Services and supersede all prior agreements and understandings.

Cancellation Policy

Effective Date: March 15, 2025

Nobody plans on cancelling, but when the situation presents itself, 10000 Bird Tours wants to make sure there is a clear understanding upfront. We strive to provide a flexible and transparent cancellation policy that accommodates both individual tour guides and tour operator companies. 

For the purposes of this policy, unforeseeable events are defined as external events such as government-imposed travel restrictions, war, civil insurrection, strike, extreme weather, earthquakes, or other natural disasters. They also include situations where a cruise ship is unable to dock or a flight to your destination is cancelled.

Please note: Unforeseeable events do not include personal or family illness or injury, poor weather, or a change of personal plans.

Cancellations due to unforeseeable events will be reviewed on a case-by-case basis, and flexibility may be offered where appropriate. For all other cancellations, our standard cancellation terms apply. We strongly recommend purchasing comprehensive travel insurance to protect your trip investment.

General Booking Deposit

  • A 15% deposit is required at the time of booking for all tours, regardless of whether the tour is provided by an individual guide or a tour operator company.
  • This deposit secures your reservation and is non-refundable in cases of late cancellations or no-shows as per the written cancellation policy. 

For Tours with Individual Guides

  • Cancellation Policy:
    • Cancellations made at least two weeks (14 days) prior to the scheduled tour date, will receive a full refund of the 15% deposit.
    • Cancellations made less than 14 days before the tour date will result in forfeiture of the deposit.
    • All tours booked with tour guides are subject to the cancellation policies of the respective guides
  • Final Payment:
    • The remaining balance is due as per the policy of the respective guides and must be paid directly to the individual guide.

For Tours with Tour Operator Companies

  • Cancellation Policy:
    • All tours booked with tour operator companies are subject to the cancellation policies of the respective operators.
    • These policies may vary, and we recommend reviewing the operator’s terms and conditions at the time of booking.

Additional Notes

  • If unforeseen circumstances require a change or cancellation of your tour, please contact us as soon as possible to discuss your options.
  • Refunds for tours booked through tour operator companies will be processed according to their policies and timelines.
  • If the guide or operator cancels without a new date being agreed upon, there will be a full refund. 
  • Any disputes or claims related to cancellations must be resolved directly with the applicable guide or operator for remaining balances on tours.
